Position Summary:
Seeking a Senior Contracts Manager / Supply Chain Consultant with expertise in managing large-scale multi-billion-dollar construction agreements and leading contracts teams, familiar with various contracting methodologies (including NEC and FIDIC) across different construction project execution types (EPCM, lump sum EPC, PMC). The role will support a Canadian-based project. Responsibilities include coordination with internal teams, Bantrel, external stakeholders, and industry suppliers. The candidate should have experience in sourcing, assessing supplier/subcontractor capabilities, and qualifying the supplier/subcontractor base. Experience under Canadian law and local content requirements is required; further experience working with Canadian-based stakeholders including local regulatory bodies, First Nations, and the supplier/subcontractor base is preferred.
JOB DIMENSIONS
A. Supervision Received
Reports directly to the Project Proposal Manager.
Receives technical and functional guidance from the Contract Functional Manager.
B. Supervision Exercised
Limited during ore-FID Services; In Execution, would provide operational supervision and technical guidance to Contract Specialist(s) and EPC counterparts.
Responsibilities:
Define contracting strategy in consultation with client and other functions with consideration of contracting model options.
Responsible for the development and management of appropriate mechanisms to monitor compliance with (sub)contract terms and conditions.
Lead team(s)toestablishment the contracting management strategy inclusive of systems, procedures and controls in coordination with othersandaligned to project and company standards.
Analyze contract terms and conditions to highlight areas of risk such as ambiguities, conflicts or deviations from the scope of work. As work proceeds, make recommendations to the PM and Client on the mitigation of these risks; closely monitor and support remedial actions and recommend appropriate tradeoffs.
Responsible for working with the other Project Team members to ensure that customer related actions or inactions which could result in compensation events are identified and mitigated.
Provide reviews and analysis of the contract financial data, establish large scale budgets and develop Key Performance Indicators for timely decisions.
Guide and assist continuous improvement and utilization of best practices.
Provide contracts reviews/audits to projects to identify potential contracts problems and process improvement opportunities. Assist in the development and implementation of systems and resources as necessary.
Communicate successes/lessons learned to the Corporate Contracts function for use in improving contract tools, upgrading the skills of Contracts personnel and improving workshops.
Job Knowledge:
Proficiency in the formation and administration of (sub)contracts through the several steps of bidder pre-qualification, compilation of bid requests, receipt of bids, bid evaluation, award, monitoring the performance of contractors, back charge procedures, and resolution of compensation events and disputes.
Working knowledge of Client policies, procedures and work practices and engineering/construction industry contracting practices
Review and redline commercial terms of numerous high-value and low-value contracts (USA and Canadian) including exhibits (i.e. exhibits payment milestones, liquidated damages, safety, scheduling requirements, reporting requirements)
Experience in developing contract types, fee arrangements and contract terms.
Experience in developing and recommending solutions to contractual issues to project management.
Alignment of cross-functional teams including engineering, construction, safety, IT, document control, project cost, and project scheduling
Preparation of special initiatives on risk management such as portfolio tariff analysis, force majeure exposure across EPC and procurement contracts, liquidated damages assessments
Qualifications and Skills
Basic Qualifications:
Related Bachelor s degree and at least 10 years experience in aspects of Contracts Management/Administration; or at least 15 years experience in Contracts Management/Administration.
Experience large scale budgets and complex stakeholder environments
Experience administering multiple standard contracts forms including NEC, JCT, ICE, and FIDIC.
Experience in pricing, contract law, contract drafting, administration and negotiation of change orders, effective correspondence, planning and scheduling.
Skilled in oral and written communication skills regarding technical and production matters with both project and supplier personnel.
Thorough knowledge of (sub)contract administration, home office and field procedures and documents relating to a multi-discipline construction project.
Strong demonstrable leadership and management experience.
Significant experience working in Canada
