Position Overview

We are seeking a highly experienced Privacy Counsel / Agency Attorney to provide surge legal support on privacy, data protection, and cybersecurity matters. This role involves advising senior leadership and agency stakeholders on complex privacy initiatives, supporting compliance efforts, and shaping privacy policy and governance across a large public-sector environment.

Key Responsibilities

Legal Advice & Counsel

• Provide expert legal advice on complex, sensitive, and time-critical privacy, data protection, and cybersecurity matters.

• Advise on federal, state, and local privacy laws and regulations impacting government agencies and cross-agency initiatives.

• Conduct and advise on privacy impact assessments and the privacy implications of new technologies and data-use initiatives.

Policy & Legislation

• Draft, review, and shape privacy-related policies, legislation, and organizational guidance.

• Monitor legislative and regulatory developments in privacy and data security; provide legal analysis and brief stakeholders on potential impacts.

Contracts & Agreements

• Draft, review, and negotiate legal agreements including:

  • Memoranda of Understanding (MOUs)

  • Non-Disclosure Agreements (NDAs)

  • Data sharing and data processing agreements

  • Terms of service and multi-agency integration agreements

• Support legal review of business use cases involving sensitive data.

Compliance & Training

• Develop policies, templates, guidance materials, and training documentation to support compliance with privacy regulations.

• Design and deliver privacy training programs for agency personnel.

Stakeholder Engagement & Representation

• Represent privacy leadership in internal and external working groups, senior-level meetings, and professional privacy forums.

• Manage relationships with government stakeholders and interagency partners on privacy-related matters.

• Engage with the public on privacy topics through panels, publications, or media activities, as directed.

Strategic Support

• Prepare legal briefs and provide strategic advice to senior government leadership.

• Support special privacy-related projects and initiatives as assigned.

Mandatory Skills & Experience

(Candidates must meet all mandatory requirements to be considered.)

• Legal Experience: Minimum 12 years of legal experience, including experience in government, intergovernmental affairs, or implementing/supporting an enterprise privacy program.

• Bar Admission: Active admission to the New York State Bar and in good standing.

• Privacy Law Expertise: Demonstrated, hands-on experience providing legal advice on complex privacy and data security laws, including:

  • U.S. federal, state, and local privacy statutes

  • Healthcare privacy laws

  • State breach notification laws

  • Consumer privacy regulations

  • International privacy frameworks impacting U.S. entities

• Document & Policy Development: Proven experience drafting and negotiating privacy-related agreements and developing organizational privacy policies, guidance, and compliance materials.

• Privacy Risk Assessments: Experience conducting or supporting privacy impact assessments or similar risk analyses.

• Technology & Data Use Advisory: Experience advising on privacy implications of emerging technologies, digital services, and data initiatives.

• Enterprise Privacy Programs: Experience supporting the implementation or operation of a large-scale or enterprise privacy program.

• Legislative Monitoring: Ability to analyze and advise on evolving privacy laws and regulations.

• Communication & Collaboration:

  • Proven ability to advise senior leadership on complex privacy matters.

  • Strong written and verbal communication skills for legal, technical, and non-technical audiences.

  • Demonstrated success working with cross-functional teams (IT, policy, operations, legal).

• Certification: At least one active IAPP certification (e.g., CIPP/US, CIPP/E, CIPM, CIPT, AIGP).

Preferred Qualifications

• Experience serving as legal counsel within a government agency or

• Extensive experience advising government clients or

• In-house legal experience within a large, complex, or highly regulated organization.
