Position Overview
The Office of Information Privacy (OIP) seeks an experienced Privacy Counsel to provide advanced legal guidance on privacy, data protection, and cybersecurity matters. The attorney will support high‐priority Administration initiatives, shape policy and legislation, negotiate complex agreements, and advise City agencies on compliance with federal, state, and local privacy requirements.
This role requires a seasoned legal professional with deep expertise in privacy law, government operations, and interagency collaboration.
Key Responsibilities
1. Legal Advice & Counsel
- Provide specialized legal advice on complex and urgent privacy, data protection, and cybersecurity issues.
- Advise City agencies on applicable privacy and data security laws including municipal, state, federal, and international frameworks.
- Conduct and review privacy impact assessments; evaluate privacy implications of new technologies and data initiatives.
2. Policy & Legislative Support
- Draft, review, and shape citywide privacy policies, guidance materials, and legislation.
- Monitor emerging privacy regulatory developments and provide legal analysis to leadership and stakeholders.
3. Contracts & Agreements
- Draft, review, and negotiate:
- MOUs
- NDAs
- Data‐sharing and data‐processing agreements
- Multi‐agency data integration agreements
- Terms of service and business use cases
- Ensure agreements meet legal and compliance standards.
4. Compliance & Training
- Create policies, templates, legal guidance, and training materials supporting agency compliance efforts.
- Lead or support privacy training programs for City personnel.
5. Stakeholder Engagement & Representation
- Represent OIP and the Chief Privacy Officer in national and international privacy forums.
- Lead or participate in interagency working groups and high‐level meetings.
- Support intergovernmental affairs with the Mayor's Office, City Council, and external stakeholders.
- Engage in public‐facing activities such as panels or publications (as directed).
6. Strategic Support
- Prepare legal briefs and offer strategic privacy counsel to senior leadership.
- Lead or support special projects and high‐priority initiatives assigned by OIP leadership.
Mandatory Qualifications
Candidates without these qualifications will not be considered.
Experience
- Minimum 12 years of legal experience including:
- NYC government and intergovernmental affairs experience, or
- Experience implementing/supporting an enterprise privacy program.
Bar Admission
- Admitted to the New York State Bar and in good standing.
Required Privacy Expertise
Demonstrated, hands‐on proficiency in:
- Advising on major privacy and data security laws (e.g., NYC Identifying Information Law, GDPR implications, CCPA/CPRA, HIPAA, breach notification laws).
- Drafting and negotiating privacy‐related agreements (MOUs, NDAs, DPAs, ToS, MSAs).
- Creating privacy policies, legal guidance, templates, and compliance materials.
- Conducting or supporting Privacy Impact Assessments (PIAs), DPIAs, and risk analyses.
- Advising on privacy implications of emerging technologies and data initiatives.
- Supporting or operating components of enterprise‐level privacy programs.
- Monitoring and analyzing privacy‐related legislation and regulatory updates.
Communication & Collaboration
- Proven ability to provide strategic legal counsel to senior executives or government officials.
- Strong written and verbal communication skills, able to translate complex issues for non‐technical audiences.
- Experience working on interdisciplinary teams (legal, IT, policy, operations).
Certifications
- At least one active IAPP certification (CIPP/US, CIPP/E, CIPM, CIPT, AIGP).
Desirable Qualifications
- Experience as an attorney within government (federal, state, or local), OR
- Extensive direct legal support to government agencies, OR
- In‐house counsel experience in a large, complex enterprise or regulated sector with significant policy/legal interplay.
